Privacy Policy

Effective date: [DATE] Last updated: [DATE]

This Privacy Policy explains how [LEGAL ENTITY NAME] ("Kinny," "we," "us," or "our") collects, uses, and shares information when you visit www.getkinny.com (the "Site"), sign up for updates, reserve a device, or book a demo.

Kinny is developing a wearable movement-measurement system. This policy covers the Site only. Our sensors and companion app are not yet available. When they ship, we will publish a separate policy covering the data those products collect, and we will notify anyone on our mailing list before that happens.

1. Information we collect

Information you give us directly

  • Email address, when you sign up for product updates or reserve a device.

  • Name, email address, phone number, and any notes you write, when you book a demo or an appointment.

  • Any other information you choose to send us, for example in an email or a message through the Site.

We do not currently take payment on the Site. If you reserve a device and we later collect a deposit or payment, payment card details will be handled directly by our payment processor and will not be stored by us.

Information collected automatically

When you visit the Site, our website host and analytics tools automatically collect:

  • IP address and approximate location derived from it (typically city or region level)

  • Browser type, operating system, and device type

  • Pages viewed, time spent on pages, and the link or search that brought you here

  • Cookie and similar identifiers

Information we do not collect on this Site

We do not collect movement data, biometric identifiers, health information, or sensor readings through this Site. We do not knowingly collect information from children (see Section 9).

2. How we use information

We use the information above to:

  • Send you product updates, launch announcements, and news you have asked to receive

  • Schedule, confirm, and follow up on demos and appointments

  • Respond to your questions and requests

  • Maintain a reservation or waitlist position, if you have requested one

  • Understand how the Site is used so we can improve it

  • Keep the Site secure and detect abuse or fraud

  • Meet legal, tax, and record-keeping obligations

We do not sell your personal information, and we do not share it with third parties for cross-context behavioral advertising.

If you are in the EEA or UK, our legal bases are: your consent (marketing emails, non-essential cookies), performance of a contract or steps taken at your request (demo booking, reservation), legitimate interests (site security, basic analytics, responding to your enquiries), and legal obligation where applicable.

3. Cookies and similar technologies

We use cookies for two purposes:

  • Strictly necessary cookies, which make the Site function — page loading, form submission, security. These cannot be disabled.

  • Analytics cookies, which tell us how the Site is used in aggregate.

Most browsers let you refuse or delete cookies through their settings. Blocking strictly necessary cookies may break parts of the Site. We honor Global Privacy Control (GPC) signals where required by law.

4. Who we share information with

We do not sell or rent your information. We share it only with:

Service providers who work on our behalf, under contracts that limit what they may do with it:

  • Squarespace — website hosting, forms, mailing list, and appointment scheduling

  • Google — analytics and/or calendar synchronization for appointment scheduling

Others, where required:

  • To comply with law, legal process, or an enforceable government request

  • To enforce our terms or protect the rights, safety, or property of Kinny, our users, or the public

  • In connection with a merger, acquisition, financing, or sale of assets, in which case we will notify you before your information becomes subject to a different privacy policy

5. How long we keep information

  • Mailing list and reservation records: until you unsubscribe or ask us to delete them, and for a short period afterward to honor your opt-out.

  • Demo and appointment records: 24 months after the appointment.

  • Analytics data: 14 months

  • Correspondence: as long as needed to resolve your request and to keep records required by law.

6. Security

We use reasonable administrative and technical safeguards, including encryption in transit (HTTPS), access controls on our accounts, and vendors who maintain their own security programs. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Your rights and choices

Everyone

  • Unsubscribe from marketing email at any time using the link in any message, or by writing to us at the address in Section 12.

  • Ask us what we hold about you, ask us to correct it, or ask us to delete it. Write to connect@getkinny.com

If you are a California resident, under the CCPA/CPRA you have the right to know what personal information we collect, use, and disclose; to request deletion; to request correction; to opt out of sale or sharing; and not to be discriminated against for exercising these rights. We do not sell or share personal information as those terms are defined by the CCPA. In the past 12 months we have collected the categories of information described in Section 1 (identifiers, internet activity, and, if you provide them, commercial and geolocation data) for the purposes in Section 2.

If you are in Colorado, Connecticut, Virginia, Texas, Oregon, Montana, or another state with a comprehensive privacy law, you have comparable rights of access, correction, deletion, portability, and opt-out, and the right to appeal a denied request by writing to connect@getkinny.com

If you are in the EEA, UK, or Switzerland, you have the rights of access, rectification, erasure, restriction, portability, and objection under the GDPR, the right to withdraw consent at any time, and the right to lodge a complaint with your local supervisory authority.

We will verify your identity before acting on a request, and will respond within the time required by applicable law.

8. International transfers

We are based in the United States, and information you provide is processed there. If you are located outside the United States, you are transferring information to a country whose data protection laws may differ from those of your own. Where required, we rely on Standard Contractual Clauses or another approved transfer mechanism.

9. Children

The Site is not directed to children under 16, and we do not knowingly collect personal information from them. If you believe a child has given us information, contact us at [PRIVACY EMAIL] and we will delete it.

10. Health, biometric, and movement data

Kinny's future products will measure body movement. Depending on how that data is used, it may qualify as biometric information or consumer health data under laws including the Illinois Biometric Information Privacy Act, the Texas Capture or Use of Biometric Identifier Act, and the Washington My Health My Data Act.

No such data is collected through this Site. Before we ship any device or app, we will publish a separate policy that describes what movement data is collected, how it is stored and shared, how long it is kept, and how you can delete it — and we will obtain any consent the law requires before collecting it.

11. Third-party links

The Site may link to sites we do not control. This policy does not apply to them, and we are not responsible for their practices.

12. Changes to this policy

We may update this policy. When we do, we will change the "Last updated" date above. If the changes are material, we will give notice on the Site or by email before they take effect.
